BLACK HISTORY CHALLENGE PROMOTION OFFICIAL RULES

(1)     No purchase necessary. (2) Promotion open to legal residents of Indiana of all ages, except employees and immediate families (spouse, parents, siblings, and children) of EMMIS Communications (40 Monument Circle, Ste 700, Indianapolis, IN 46204), Pepsi-Cola General Bottlers of Indiana, Inc. (3501 Algonquin Road, Rolling Meadows, IL 60008), Indiana Historical Society (450 W. Ohio Street, Indianapolis, IN 46202), the Indianapolis-Marion County Public Library (40 E. St. Claire Street, Indianapolis, IN 46204), Pacers Basketball Corporation d/b/a Indiana Pacers, Pacers Sports & Entertainment and Conseco Fieldhouse (collectively, “Pacers”) (125 S. Pennsylvania Street, Indianapolis, IN 46204), the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, directors, owners, employees and agents.  (3) To enter, beginning February 1, 2008, (i) obtain a game card at one of the following websites: www.indianahistory.org, www.pacers.com or www.imcpl.org, or (ii) obtain a game card by visiting the Indiana Historical Society or (iii) visit any Indianapolis-Marion County Public Library branch or Bookmobile and request a game card.  Answer the ten (10) trivia questions about Black History on the game card and hand-deliver the completed game card to the Indiana Historical Society or any participating Indianapolis-Marion County Public Library branch or Bookmobile or mail it to the Indiana Historical Society.  All non-mailed in entries must be received by the Indiana Historical Society or any participating Indianapolis-Marion County Public Library branch or Bookmobile by 5:00 PM Indianapolis time February 29, 2008 and all mailed-in entries must be postmarked by February 29, 2008 and received by the Indiana Historical Society at 450 W. Ohio Street, Indianapolis, IN 46202 by March 5, 2008.  Limit one (1) entry per person.  The first five thousand (5,000) entrants will receive an Animal Puffer Ball ($.70 retail value).  (4)  First place winners will be those eligible entrants that answer all of the questions correctly, provided however, that in no event will there be more than twenty-five (25) first place winners.  In the event that more than twenty-five (25) eligible entrants answer all of the questions correctly, the twenty-five (25) first place winners will be chosen randomly from the eligible entries received that have all correct answers.  In the event the winner cannot be contacted or declines the prize another winner will be chosen at random from all eligible, completed and correct game cards.  (5) Prizes:  First place winners will receive a Pacers Backpack ($4.23 value) and a copy of a book about a historically significant African-American Indiana High School basketball and NBA Legend ($19.95 value).  One (1) Grand Prize winner will be selected from the pool of first place winners and will receive four (4) tickets to the Indiana Pacers v. Miami Heat game on Monday, March 31, 2008 ($650 per ticket/$2,600 total value), a Pacers goodie bag ($10.00 value), an Achievement Certificate ($5.00 value), and a commemorative photo ($5.00 value).  Maximum total value of all prizes, assuming twenty-five (25) first place winners, is $3,224.50.  The winning prizes are non-transferable to any other person, including relatives or friends.  (6) Winners are solely responsible for all applicable federal, state and local taxes and any expenses (including but not limited to travel expenses) associated with the promotion, unless otherwise indicated.  No substitution, cash equivalent or transfer of prize permitted except at the Pacers’ option for a prize of comparable or greater value.  (7) In the event that more than twenty-five (25) eligible entrants answer all of the questions correctly, chances of winning are dependant upon the number of eligible entries received that have all correct answers.  Chances of being the Grand Prize winner are one (1) out of the total number of first place winners.  (8) A list of winners can be obtained by writing the Indianapolis-Marion County Public Library, Black History Challenge, c/o Tami Edminster, 40 E. St. Claire Street, Indianapolis, IN 46204.  (9) By entering, entrant agrees to follow the Official Rules and hold harmless and indemnify EMMIS Communications, Indiana Historical Society, Pepsi-Cola General Bottlers of Indiana, Inc., the Indianapolis-Marion County Public Library, Pacers Basketball Corporation d/b/a Indiana Pacers, Pacers Sports & Entertainment and Conseco Fieldhouse, and/or the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, owners, shareholders, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant’s participation; or (ii) the receipt or use of the prizes awarded in the promotion.  (10) In consideration for being awarded the prize, winner hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of winner’s name and/or likeness in any and all advertising, promotions and other publicity conducted by EMMIS Communications, Indiana Historical Society, Pepsi-Cola General Bottlers of Indiana, Inc., the Indianapolis-Marion County Public Library, Pacers and/or the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries and affiliates, except where prohibited by law.  (11)  If the winner is under eighteen (18) years of age, the prize may be awarded in the name of the winner’s parent/legal guardian and said parent/legal guardian may be required to sign an affidavit of eligibility and publicity release in order to claim the prize. (12) Void where prohibited.
